9 HOW WE USE YOUR PERSONAL INFORMATION

We may share your personal data with the parties set out below for the purposes set out in the table in paragraph 8 above:

  • Our affiliates;
  • Other companies based in the UK or EEA provide us with legal and finance services, acting as joint controllers or processors controllers including lawyers, bankers, auditors and insurers based within the UK who provide consultancy, banking, legal, insurance and accounting services;
  • Service providers acting as processors who provide IT, logistics, payment providers, and system administration services such as:
    • our suppliers;
    • IT services providers;
    • our web development agency SOZO Design Ltd;
    • third party payment providers such as PayPal and Checkout.com;
    • third party service providers which help us fulfil orders and respond to enquries such as Mintsoft, Unleashed, Xero and Gorgias.
  • HM Revenue & Customs, regulators and other authorities acting as processors or joint controllers based in the UK who require reporting of processing activities in certain circumstances;
  • Third party services providers such as Klaviyo, based in the USA, to deliver our e-newsletter. You will only receive direct marking communications where you have expressly consented to do so, and you can opt-out at any time.
  • Third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this privacy notice.

International Transfers

Some of our external third parties are based outside the UK and the European Economic Area (EEA) so their processing of your personal data will involve a transfer of data outside the UK and the EEA.

Whenever we transfer your personal data out of the UK and the EEA, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:

10 USE OF YOUR PERSONAL INFORMATION ONLY WHERE WE HAVE YOUR CONSENT

11 HOW LONG WE RETAIN YOUR PERSONAL INFORMATION

In general, we will retain your information for no longer than necessary, taking into account the following:

  • The purpose(s) for which we are processing your personal information, such as whether it is necessary to continue to store that information in order to continue to perform our obligations under a contract with you or for our legitimate interests;
  • Whether we have any legal obligation to continue to process your information, such as any record-keeping obligations imposed by applicable law; and
  • Whether we have any legal basis to continue to process your personal information, such as your consent.

To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.

Where you order goods or services from us, we will retain your information for six years from the end of the financial year in which you purchased those goods or services from us, in accordance with our legal obligations to keep records for tax purposes.

In some circumstances you can ask us to delete your data: see Your Rights at paragraph 14 below for further information. In some circumstances we may anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.

Where you contact us with an enquiry, we will retain your information for as long as it takes to respond to and resolve your enquiry, and for 6 further month(s), after which point we will delete your information.

12 HOW WE SECURE YOUR PERSONAL INFORMATION

We take appropriate technical and organisational measures to secure your personal information and to protect it against unauthorised or unlawful use or processing as well as against the accidental loss or destruction of, or damage to, your personal information, including:

  • To object to the processing of your personal information for certain purposes (for further information, see the section below entitled ‘Your right to object to the processing of your personal information for certain purposes’); and

16 YOUR REQUEST TO ACCESS YOUR PERSONAL INFORMATION

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

Where you request access to personal information, we are required by law to use all reasonable measures to verify your identity before doing so. Where we possess appropriate information about you on file, we will attempt to verify your identity using that information. If it is not possible to identity you from such information, or if we have insufficient information about you, we may require original or certified copies of certain documentation in order to be able to verify your identity before we are able to provide you with access to your personal information.

These steps are necessary to verify your identity in order to reduce the risk of identity fraud or identity theft by persons other than yourself asking for access to your personal information.

We try to respond to all legitimate requests within one month. Occasionally it may take us longer than

a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

17 YOUR RIGHT TO OBJECT TO THE PROCESSING OF YOUR PERSONAL INFORMATION FOR CERTAIN PURPOSES

You have the following rights in relation to your personal information, which you may exercise in the same way as you may exercise the rights in the preceding section (Your rights in relation to your personal information):

18 CONSEQUENCES OF NOT PROVIDING YOUR PERSONAL INFORMATION TO US

Where you wish to purchase products or services from us, we require your personal information in order to enter into a contract with you. We may also require your personal information pursuant to a statutory obligation (in order to be able to send you an invoice for products and services you wish to order from us, for example).

If you do not provide your personal information, we will not be able to enter into a contract with you or to provide you with those products or services.

19 CHANGES TO OUR PRIVACY POLICY

We may change our Privacy Policy from time to time without providing prior notice to you. If required by law, we will make such changes to our Privacy Policy known to you by posting a notice on the website and/or by us posting an updated version of our Privacy Policy on our website with a new effective date stated at the beginning of it. Our processing of your personal information will be governed by the practices set out in that new version of the Privacy Policy from its effective date onwards.
